Delegate Butler moves to amend the bill on page three, section four, line ten, by striking out subsection (c) in its entirety and inserting in lieu thereof a new subsection (c) to read as follows:
(c) The county commission shall, not less than 90 days before the election, order that the issue be placed on the ballot and referendum held at the next general election to determine whether it is the will of the voters of the county that a county public safety sales or amusement tax is necessary prior to issuing the order, the county commission shall publish notice as a Class II legal advertisement in compliance with the provisions of §59-3-1 et seq. of this code, and the publication area for such publication shall be the county in which the county public safety sales and amuse tax would be enacted. Such notice shall include the time and place of public hearings to be held within each magisterial district of the county as defined by the provisions of §7-2-2. Each hearing shall be scheduled no later than 60 days before the election, shall have a start time of notearlier than 5:30 p.m. but not later than 7p.m. on a weekday, shall allow for both in-person and virtual attendance and shall require the taking of a public roll to determine the number of residents in attendance. If less than 20 percent of registered voters within any magisterial district attend any one of the scheduled public hearings then the election shall be cancelled.
